Indigenous lands protect biodiversity, the climate, and a living history that cannot be erased. In 1988, the Constitution recognized the right of Indigenous peoples to their traditional lands — a historic achievement of justice.
Now, the Temporal Framework theory threatens all of this: it attempts to limit Indigenous rights only to lands occupied up until 1988, ignoring centuries of forced expulsions and violence. It also imposes new obstacles to land demarcation, putting lives and forests at risk.
In December 2023, Law 14.701 attempted to turn this theory into law. But the future can still be different: the Federal Supreme Court (STF) can defend justice and constitutional rights.
